Text Messaging
As part of its Digital Engagement Services, ImageMover may send outbound text message campaigns on behalf of the Customer, as directed by the Customer. These messages may be for general education and awareness, targeted interventions, a supplement clinical services, or other outbound messaging campaigns as agreed to by the parties and in compliance with applicable laws. Messages are transmitted through ImageMover's messaging infrastructure using the Customer's name and identity.
These practices apply to all SMS communications facilitated by ImageMover and govern how messages are sent, what they contain, and how recipient preferences are honored.
Sender Identity and Authorization
All text messages are sent by ImageMover on behalf of, and in the name of, the Customer. Recipients receive messages that identify the Customer as the sender. ImageMover transmits messages through its own registered phone numbers and third-party messaging vendor relationships.
Messages are sent using the Customer's name as the displayed sender identity.
Customers authorize ImageMover to send messages on their behalf as part of the Digital Engagement Services delivered under the Agreement.
Recipient Consent and Opt-Out
All text message campaigns are conducted in compliance with the Telephone Consumer Protection Act (47 U.S.C. § 227) and applicable FCC regulations. Key compliance measures include:
Customer has taken responsibility for collecting the appropriate consents from recipients for these messages and agrees that ImageMover is not responsible for claims that the recipient of the text message did not consent to this type of text message from Customer.
Every campaign provides a clear and easy mechanism for opting out of the campaign in the initial message. An example initial message text will read as follows: “Hi <RECIPIENT NAME>, you’re signed up to receive text messages about [TOPIC] from Customer. If you’d like to stop receiving messages from Customer about [TOPIC], you can opt out here: <OPT-OUT URL>.
All reasonable attempts by a recipient to opt out of the campaign will be honored.
Opt-out mechanics:
Each opt-out link is unique to the individual recipient.
Opt-out requests are processed promptly and no further campaign messages will be sent to opted-out recipients.
ImageMover will provide opt-out records to the Customer upon request.
Message Content
Messages are informational to relay a message about healthcare, services, or supplies appropriate for the consent Customer has to message the recipient. . Content may include:
Notifications of eligibility for medication reviews or clinical services covered by the patient's insurance.
Reminders to speak with a pharmacist or visit the pharmacy.
General educational information related to medications or treatment adherence.
Message content
All message content is reviewed for accuracy and compliance with applicable healthcare communications standards prior to deployment. Messages will not include promotional offers or third-party advertising.
ImageMover reserves the right to refuse to transmit any content by text message when ImageMover does not in good faith believe such transmission complies with applicable laws.
Timing and Frequency
Messages are sent only between 8:00 a.m. and 8:00 p.m. in the patient's local time zone.
Message frequency typically does not exceed approximately once per month per recipient for the duration of a program.
